I. General
Terms and Conditions § 1 Basic Provisions
(1) The following terms and conditions apply to contracts that you conclude with us as a supplier via the biogo.de website. Unless otherwise agreed, the inclusion of the terms you use is excluded.
(2) A consumer within the meaning of these terms and conditions is any natural person who concludes a legal transaction for a purpose that cannot be attributed primarily to their commercial or independent professional activity. An entrepreneur is any natural or legal person or partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of their independent professional or commercial activity.
§ 2 Conclusion of contract
(1) The subject of the contract is the sale of goods.
(2) As soon as a product is listed on our website, we make a binding offer to conclude a contract via the online shopping cart system under the conditions specified in the item description.
(3) The contract is concluded via the online shopping cart system as follows:
The goods to be purchased are placed in the "shopping cart". You can use the corresponding button in the navigation bar to call up the "shopping cart" and make changes at any time.
If you call up the "Checkout" page and enter your personal data as well as the payment and shipping conditions, your order data will be displayed as an order overview.
If you use an instant payment system (e.g. PayPal / PayPal Express, Amazon Payments, Sofortüberweisung) as a payment method, you will be redirected to the order overview page in our online shop or to the website of the provider of the instant payment system.
If you are redirected to the appropriate instant payment system, make the appropriate selection or enter your details there. Finally, your order data will be displayed as an order overview on the website of the provider of the instant payment system or when you are forwarded to our online shop.
Before sending your order, you have the option of checking the details in the order overview again, changing them (also using the "Back" function of your browser) or canceling the order.
By sending your order via the corresponding button ("order with obligation to pay" or similar designation), you declare your acceptance of the offer in a legally binding manner, whereby a contract is formed.
(4) Your request to make an offer is not binding on you. We will make you a binding offer in text form (e.g. by e-mail), which you can accept within 5 days (unless a different period is specified in the respective offer).
(5) The processing of your order and the transmission of information required in connection with the conclusion of the contract takes place by e-mail, in some cases automatically. You must therefore ensure that the e-mail address you provide is correct, that the receipt of the e-mail is technically guaranteed and, in particular, that there are no SPAM filters preventing this.
§ 3 Contract period / termination of the subscription contract
(1) The subscription contract concluded between you and us has an agreed term. If the contract is not terminated by one of the parties in text form (e.g. e-mail) 3 weeks before the end of the contract (unless a different period is specified in the respective offer), it is automatically extended by the agreed basic term. However, if the basic term is longer than one year, the contract is only extended by one year at a time.
(2) The right to termination without notice for important reasons remains unaffected.
§ 4 Special agreements on offered means of payment
(1) Credit Check
If we make an advance payment, e.g. to pay an invoice or direct debit, your data will be passed on to SCHUFA Holding AG, Komoranweg 5, 65201 Wiesbaden, to protect our legitimate interests, for the purpose of a credit check based on statistical processes. We reserve the right to refuse the payment method invoice or direct debit due to the credit check.
(2) Payment via Klarna
In cooperation with Klarna Bank AB (publ) , Sveavägen 46, 111 34 Stockholm, Sweden, we offer you the following payment options. Payment to Klarna is made in any case:
Sofortüberweisung: Available in Germany. Your account will be charged immediately after placing your order.
